This Website Privacy Policy explains how Encore Family Life Insurance Solutions (“Encore,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects personal information when you visit encorefamilysolutions.com, use an Encore landing page, complete an online form or survey, request information, schedule an appointment, communicate with us, or otherwise use a website-related service that links to this Policy (collectively, the “Site”).
This Policy covers general website, marketing, recruiting, agency-partnership, and introductory intake activity. Information collected in connection with an insurance application, policy, annuity contract, or insurance customer relationship may also be governed by our separate Insurance Privacy Notice, an insurance carrier’s privacy notice, and transaction-specific disclosures. If a more specific notice applies, that notice controls for the information and activity it addresses.
1. Who We Are
Encore Family Life Insurance Solutions is a California-licensed independent insurance agency. 2. Personal Information We Collect
Depending on how you interact with the Site, we may collect:
Information you provide
- Identifiers and contact information, such as your name, email address, telephone number, state, ZIP code, and mailing address if voluntarily provided.
- General retirement and insurance profile information, such as age or age range, retirement timeline, general account type, approximate asset range, existing annuity or life-insurance interests, business ownership, and general financial, protection, retirement, or legacy goals.
- Professional and agency inquiry information, such as producer or agency status, licensing information you choose to provide, areas of production, team or agency size, contracting interests, recruiting interests, technology/training interests, and partnership goals.
- Form, survey, and appointment information, including responses to introductory questions, requested appointment times, communication preferences, and information you include in a message.
- Communications and consent records, such as emails, call or text preferences, opt-in and opt-out records, timestamps, source pages or campaigns, and the consent language presented at the time.
- Communications and AI-assisted information, such as call recordings or transcripts where lawfully made, chatbot or online-chat conversations, voicemail messages, and notes, summaries, or classifications created with assistance from automated tools.
Information not intended for general public forms
General Site forms are not intended to collect Social Security numbers, complete financial-account numbers, banking credentials, payment-card information, medical records, insurance applications, copies of identification, detailed suitability documents, or other highly sensitive insurance or financial information. Please do not submit that information through a public form, ordinary email, text message, or chatbot. If it is needed, an authorized professional will direct you to an approved secure process.
Information collected automatically
We and service providers supporting the Site may collect limited technical and usage information, such as IP address, browser and device characteristics, operating system, referring and exit pages, pages viewed, general interaction information, approximate geographic area derived from IP address, and cookie or similar online identifiers.
3. How We Collect Information
We may collect information:
- directly from you through forms, surveys, appointment tools, calls, texts, emails, or other communications;
- automatically through cookies, logs, analytics tools, and similar technologies used on public Site pages;
- from a licensed producer, agency representative, or other person authorized to work with Encore;
- from technology, customer-relationship-management, communications, appointment, marketing, or operational service providers acting for Encore; and
- from carriers, insurance organizations, or other parties involved in an insurance transaction you request, as permitted by law and described in the applicable Insurance Privacy Notice.
4. How We Use Personal Information
We may use information to:
- respond to inquiries and provide requested information;
- determine the appropriate Encore contact, resource, or next step;
- schedule, confirm, and manage appointments;
- provide general educational information about insurance, annuities, retirement income, business-owner planning, and legacy planning;
- support producer, agency, contracting, recruiting, technology, training, or partnership inquiries;
- conduct an insurance needs, suitability, best-interest, or product review through an appropriately licensed professional when you choose to proceed;
- send calls, texts, or emails according to the consent provided and applicable law;
- maintain consent, suppression, do-not-contact, compliance, and communication records;
- operate, secure, troubleshoot, measure, and improve the Site;
- prevent fraud, misuse, or unauthorized access;
- comply with insurance, privacy, communications, recordkeeping, legal, and regulatory obligations; and
- establish, exercise, or defend legal rights.
The public Site does not make an individualized insurance recommendation solely from public-form responses. Any individualized product recommendation must occur through an appropriate review by a properly licensed professional and is subject to product availability, carrier requirements, and applicable law.
If a question is asked solely for marketing or research in connection with an insurance transaction, Encore will clearly identify that purpose as required by applicable California insurance law.
5. Insurance and Financial Privacy
Information collected in connection with an insurance transaction may be nonpublic personal information under state and federal insurance privacy laws. Encore maintains a separate Insurance Privacy Notice describing the collection, disclosure, safeguarding, access, correction, amendment, deletion, and privacy-choice practices that apply to covered insurance information.
The Website Privacy Policy does not replace an Insurance Privacy Notice required in connection with an insurance transaction or customer relationship. Carriers and other financial institutions involved in a transaction may provide their own privacy notices governing their separate handling of information.
6. Calls, Text Messages, Email, Recording, and AI-Assisted Tools
If you provide contact information, we may use it to respond to your request and to send communications authorized by your consent or otherwise permitted by law. The exact consent language displayed at the point of collection controls the communication methods and technologies you authorize.
- Consent to marketing calls or texts is not a condition of purchasing any product or service.
- A general inquiry or appointment request does not by itself authorize recurring marketing texts or artificial, prerecorded, or AI-generated voice marketing calls where separate consent is required.
- You may revoke call or text consent through any reasonable method, including telling the caller, contacting Encore, or replying STOP where available.
- You may unsubscribe from marketing emails through the unsubscribe method provided in the message.
- Transactional, servicing, security, or legally required communications may continue where permitted by law.
Encore or authorized providers may use recording, transcription, chatbot, scheduling, summarization, classification, quality-assurance, security, compliance, or other AI-assisted tools. Where notice or consent is required for recording or similar activity, it will be provided through the applicable communication. These tools do not replace required professional judgment, licensing, suitability, best-interest, underwriting, or compliance review.
7. How We Disclose Personal Information
We may disclose personal information when reasonably necessary and permitted by law to:
- Encore personnel and appropriately licensed professionals who need the information to respond to your request or provide authorized services;
- insurance carriers, insurance organizations, and transaction partners when you request an insurance review, quote, application, placement, or related service;
- service providers supporting website hosting, CRM, appointment scheduling, email, calling, text messaging, document handling, security, analytics, automation, AI-assisted tools, or campaign administration;
- professional advisers such as legal, compliance, accounting, audit, or security professionals;
- regulators, courts, government authorities, law enforcement, or other persons when disclosure is required or permitted by law or legal process;
- parties involved in a lawful merger, reorganization, financing, acquisition, or transfer of business assets, subject to applicable confidentiality and privacy requirements; and
- other persons at your direction or with your authorization.
Encore uses due diligence when selecting service providers that handle customer information. Where California insurance privacy safeguards apply, Encore requires those service providers by contract to use appropriate measures designed to protect customer information. Service providers are also subject to applicable restrictions concerning use, disclosure, retention, and security.
8. Cookies, Analytics, and Advertising Measurement
The Site may use technologies necessary for security, functionality, preferences, fraud prevention, and basic operation. Service providers may process limited technical and usage information on Encore’s behalf to host, secure, operate, troubleshoot, and measure the Site.
At launch, Encore does not intentionally enable third-party advertising pixels or similar technologies for the purpose of allowing third parties to collect personally identifiable information about visitors’ online activities over time and across unaffiliated websites for their own behavioral-advertising purposes. If Encore later enables analytics, advertising, or other technologies that materially change these practices, Encore will update this Policy and provide any notice, consent, opt-out, or other choice required by applicable law.
Encore does not intend to transmit to advertising platforms the contents of insurance or financial intake forms, names, email addresses, telephone numbers, asset ranges, retirement timelines, appointment details, insurance status, CRM identifiers, suitability information, replacement information, health information, or other restricted insurance information.
Advertising pixels should not operate on secure intake, fact-finder, application, suitability, document-upload, client-service, or post-submission pages where an event could reveal restricted insurance or financial information about an identifiable person.
California Do Not Track and Browser Privacy Signals
Some browsers transmit legacy “Do Not Track” (“DNT”) signals. Because there is no uniform industry standard for legacy DNT signals and Encore does not currently use cross-site behavioral-advertising technologies as described above, Encore does not currently respond to legacy DNT signals as a separate preference mechanism. Where applicable law requires recognition of a browser-based opt-out or privacy preference signal, Encore will honor that signal as required by law.
9. Sale and Sharing
Encore does not sell personal information for money. Encore does not sell nonpublic insurance information, mobile opt-in information, or consent records. Encore also does not disclose covered nonpublic personal financial information to nonaffiliated third parties for their own marketing without following any notice and opt-out requirements that apply under California insurance privacy law.
Some privacy laws define “sale” or “sharing” more broadly than a monetary sale and may apply to certain online advertising or analytics practices. If Encore engages in a practice for which applicable law requires an opt-out or other choice, Encore will provide the required mechanism.
Insurance-information disclosures are further addressed in the separate Insurance Privacy Notice.
10. Data Retention
Encore retains personal information only as long as reasonably necessary for the purposes described in this Policy or as required by insurance, legal, regulatory, contractual, security, dispute-resolution, and recordkeeping obligations. Retention periods vary by record type and relationship. Information that is no longer reasonably necessary will be deleted, deidentified, or securely disposed of, subject to legal holds, suppression records, and records that must be retained.
11. Data Security
Encore uses administrative, technical, and physical safeguards designed to protect personal information, including access controls, unique accounts, multifactor authentication where available, data minimization, approved systems, vendor oversight, and incident-response procedures appropriate to Encore’s operations.
No transmission or storage system can be guaranteed to be completely secure. If you believe personal information has been submitted improperly or accessed without authorization, contact privacy@encorefamilysolutions.com promptly.
12. Privacy Choices and Rights
Depending on your location, the type of information, and the law that applies, you may have rights to request access, correction, amendment, deletion, or other information about our handling of personal information; withdraw certain consents; or opt out of certain marketing or data-sharing practices.
California insurance-information rights are described in the Insurance Privacy Notice, including rights concerning access to and correction, amendment, or deletion of certain recorded personal information.
Privacy requests may be submitted to:
Email: privacy@encorefamilysolutions.com
Phone: (619) 841-2943 ext. 800
Mail: P.O. Box 601913, San Diego, CA 92160
Encore may verify identity and authority before fulfilling a request. Certain information may be exempt from a request or may need to be retained to satisfy insurance, legal, regulatory, fraud-prevention, security, contractual, or recordkeeping requirements. Encore will not unlawfully discriminate against a person for exercising an applicable privacy right.
13. Minors Under 18
The Site is intended for adults and is not directed to or advertised to persons under 18. Encore does not knowingly solicit or collect personal information directly from minors under 18 through general website forms for marketing or insurance-application purposes.
Insurance involving a minor must be handled with the involvement and authorization of a parent, legal guardian, or other person legally authorized to act for the minor, as required by applicable law and carrier rules. A minor should not submit an insurance application, sensitive financial information, medical information, or other transaction-specific information through the public Site on the minor’s own behalf.
If you are a parent or legal guardian and believe a minor has submitted personal information through the Site without appropriate authorization, contact privacy@encorefamilysolutions.com so Encore can review the matter and take appropriate action, which may include deletion or restriction of the information subject to legal and recordkeeping requirements.
14. Third-Party Websites and Services
The Site may link to carrier websites, scheduling providers, technology platforms, social media, or other independent third-party services. Those parties control their own privacy practices, terms, security, and services. Review their notices before providing information directly to them.
15. Changes to This Policy
Encore may update this Policy to reflect changes in law, technology, vendors, Site features, or business practices. The “Last Updated” date identifies the current version. Material changes will receive additional notice where required by law.
