These Website Terms of Use (“Terms”) govern your access to and use of encorefamilysolutions.com and any Encore Family Life Insurance Solutions landing, scheduling, form, recruiting, agency-partnership, or other website page that links to these Terms (collectively, the “Site”).

The Site provides general insurance and retirement education, introductory intake, scheduling, communication, producer/agency information, and business-development information. The Site does not itself issue an insurance policy, bind coverage, complete an insurance transaction, or make an individualized product recommendation.

1. Acceptance and Scope

By using the Site, you agree to these Terms. If a page presents an affirmative checkbox, acceptance button, or similar control, your affirmative action may constitute electronic acceptance to the extent permitted by law.

These Terms govern general Site use only. They do not replace an insurance policy or annuity contract, application, carrier form, disclosure, illustration, buyer’s guide, replacement notice, privacy notice, contracting agreement, commission schedule, technology agreement, recruiting agreement, advisory agreement, or other transaction-specific document. The more specific document controls the subject it addresses, and an issued insurance contract controls product rights and benefits.

Encore offers or supports insurance activity only where Encore and the responsible insurance professional are properly licensed, authorized, and appointed as required. Licensing, carrier appointments, products, features, and availability vary by jurisdiction. Nothing on the Site is an offer to transact insurance where doing so would be unlawful.

Encore is not, merely by operating this Site, a securities broker-dealer, registered investment adviser, bank, trust company, law firm, accounting firm, or tax adviser. Any service requiring a separate professional license or agreement must be provided by the appropriately authorized professional under that professional’s own disclosures and terms.

3. Site Purpose and Advertising Status

The Site may contain general educational or promotional information concerning life insurance, annuities, retirement income, business-owner planning, legacy planning, advanced insurance markets, contracting, leads, technology, training, recruiting, and agency-development opportunities.

Site content is not an insurance policy, binder, contract, quote capable of acceptance, guarantee of carrier issuance, guarantee of contracting, or guarantee of business results.

4. General Education; No Individualized Advice or Fiduciary Relationship

Site content is general and educational. It is not individualized insurance, investment, tax, legal, accounting, estate-planning, retirement-plan, or financial-planning advice and is not a recommendation to purchase, replace, exchange, surrender, borrow from, or modify an insurance or annuity product; transfer or roll over retirement assets; liquidate investments; or alter an existing financial plan.

Using the Site, submitting an introductory form, watching a video, using an educational tool, or scheduling a conversation does not by itself create an agent-client, adviser-client, fiduciary, attorney-client, accountant-client, or other professional relationship.

Any individualized insurance recommendation must be made by an appropriately licensed professional after gathering and evaluating relevant information. Nothing in these Terms limits nonwaivable best-interest, suitability, care, disclosure, conflict-of-interest, documentation, licensing, or other legal duties.

5. Insurance and Annuity Information

Insurance and annuity contracts are issued by insurance carriers. Product descriptions, rates, crediting methods, index options, caps, participation rates, spreads, bonuses, riders, charges, surrender periods, withdrawal provisions, income benefits, death benefits, tax references, projections, and other features are summaries only and may change.

  • Guarantees are subject to the issued contract and the financial strength and claims-paying ability of the issuing insurer.
  • Fixed indexed annuities are insurance products and are not direct investments in a market index.
  • Insurance and annuity products are not bank deposits and are not insured by the FDIC or SIPC.
  • Withdrawals, replacements, exchanges, surrenders, transfers, or early termination may involve charges, loss of benefits, taxes, or other disadvantages.
  • Examples, projections, case studies, illustrations, and testimonials are not guarantees of results.

Do not purchase, replace, exchange, surrender, transfer, or roll over assets based solely on Site content. Review actual carrier-approved materials and applicable transaction-specific disclosures with the responsible licensed professional.

6. Quotes, Applications, Underwriting, and Coverage

Any preliminary quote, rate, estimate, illustration, or product discussion is nonbinding unless confirmed through the carrier’s approved process. Eligibility, premiums, benefits, and issuance may depend on state, age, health, financial information, underwriting, suitability or best-interest review, carrier rules, and other factors.

Submitting information or an application does not guarantee acceptance or create coverage. Coverage and contractual rights begin only as stated in the issued contract after all carrier requirements are satisfied.

Do not use a public form, ordinary email, text message, chatbot, or voicemail for time-sensitive instructions to bind, cancel, replace, surrender, reinstate, transfer, change, or exercise rights under an insurance contract. Use the carrier or other authorized process.

7. Insurance Professional, Contracting, and Agency Opportunities

The Site may describe opportunities for insurance professionals or agencies, including contracting, production resources, leads, Divine Reach services, TFC technology or training, advanced-market support, recruiting, agency development, strategic partnerships, and enterprise-development concepts.

These descriptions are general and do not guarantee:

  • appointment or contracting with any carrier or organization;
  • a particular contract level or commission rate;
  • lead quantity, quality, appointment volume, or conversion;
  • production, commissions, overrides, revenue, or profitability;
  • recruiting results or agency growth;
  • enterprise value, financing, recapitalization, acquisition, or exit; or
  • continued availability of any partner, technology, program, service, or opportunity.

Contracting, compensation, hierarchy, access, and participation may be subject to licensing, state, carrier, IMO or organization approval, production, compliance, background, training, eligibility, written agreement, and other requirements.

Nothing on the Site is an offer to sell a security, equity interest, franchise, or guaranteed business opportunity. Any equity, acquisition, compensation, employment, licensing, technology, partnership, or other business arrangement must be documented separately in an applicable written agreement.

Third-party or separately operated programs and platforms may be subject to their own terms, privacy notices, availability, and approval requirements.

8. Forms, Surveys, Appointments, and User Submissions

Public Site forms are intended for introductory information. Submitting a form requests the response or service described at the point of collection; it does not obligate you to purchase a product or guarantee that Encore will accept or continue an engagement.

Do not submit Social Security numbers, complete financial-account numbers, banking credentials, medical records, insurance applications, copies of identification, or other highly sensitive information through a public form, chatbot, ordinary email, or text. If such information is needed, an authorized professional will direct you to an approved process.

You remain responsible for the accuracy of information you provide and for having authority to provide information concerning another person.

If a question is designed solely to obtain information for marketing or research in connection with an insurance transaction, Encore will clearly identify that purpose as required by applicable California insurance law.

Minors Under 18

The Site is intended for adults and is not directed to or advertised to persons under 18. Minors should not submit applications, sensitive personal information, or transaction-specific insurance information through the public Site on their own behalf. Insurance involving a minor must be handled with the involvement and authorization of a parent, legal guardian, or other person legally authorized to act for the minor, as required by applicable law and carrier rules.

9. Calls, Text Messages, and Email

The exact notice and consent language presented when contact information is collected controls the communications you authorize. A general inquiry may permit Encore to respond to that inquiry using methods permitted by law, but it does not by itself authorize recurring marketing texts or artificial, prerecorded, or AI-generated voice marketing calls where separate consent is required.

Where required, marketing-text or automated/AI-voice consent will be requested separately and will not be a condition of purchasing an insurance product or service. Consent may be revoked through reasonable methods provided by law and the applicable communication.

10. Recording, Transcription, Chatbots, and AI-Assisted Tools

Encore or authorized providers may use recording, transcription, chatbot, scheduling, summarization, classification, quality-assurance, security, compliance, or other AI-assisted tools. Required notice and consent will be provided where applicable. These Terms do not themselves constitute consent to record a confidential communication.

AI-assisted outputs may be incomplete or inaccurate and are not final insurance recommendations, underwriting decisions, legal conclusions, or authoritative records without appropriate review. Encore does not rely solely on automated output to make final insurance eligibility, suitability, best-interest, or product-recommendation decisions.

11. Privacy and Insurance Privacy Notices

Encore’s Website Privacy Policy explains general Site privacy practices. Encore’s separate Insurance Privacy Notice addresses covered insurance information and California insurance-information rights. A carrier or other financial institution may also provide a separate privacy notice.

Where notices conflict for a particular subject, the more specific applicable notice governs that subject.

12. Third-Party Services, Licensed Professionals, Carriers, and Referrals

Encore may use authorized website, technology, CRM, scheduling, communications, security, analytics, document, automation, AI, and administrative service providers. Encore may also refer or assign an inquiry to an appropriately licensed professional, carrier, insurance organization, or business partner when appropriate and permitted.

Independent carriers, professionals, and third parties control their own products, underwriting, contracts, compensation, websites, security, privacy practices, and services. Encore does not represent that every carrier, product, contract, lead source, technology, or opportunity in the market is available through Encore.

13. Electronic Records and Signatures

When a Site workflow expressly identifies an action as an electronic signature or consent, an affirmative checkbox, typed name, acceptance button, or similar action may serve as an electronic signature to the extent permitted by law. Transaction-specific electronic-delivery and signature disclosures control the transaction they address.

Acceptance of these Terms alone is not consent to receive an insurance policy or another record electronically where separate consent is required.

14. Intellectual Property

Unless otherwise stated, Site text, graphics, layout, branding, trademarks, service marks, videos, educational content, and other materials are owned by or licensed to Encore or the applicable rights holder. You may use the Site for lawful personal or internal business evaluation. You may not copy, sell, republish, modify, scrape, reverse engineer, or exploit Site content in violation of law or applicable rights without authorization.

Third-party names, logos, marks, and materials remain the property of their respective owners.

15. Prohibited Use

You may not use the Site to engage in fraud, impersonation, unlawful solicitation, unauthorized data collection, interference with security, malicious code, unauthorized access, intellectual-property infringement, or other unlawful activity. You may not use automated means to access or extract Site content in a manner that materially burdens the Site or violates applicable law.

16. Site Availability and Security

Encore uses reasonable measures designed to operate and secure the Site, but no website, transmission, storage system, or automated tool can be guaranteed to be uninterrupted, error-free, or completely secure. Site functions may be unavailable because of maintenance, outages, vendor failures, security events, network conditions, or circumstances beyond Encore’s reasonable control.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and general Site content are provided on an “as is” and “as available” basis without warranties that the Site will be uninterrupted, error-free, complete, current, or suitable for a particular purpose. This disclaimer does not alter warranties, rights, or duties imposed by an issued insurance contract or nonwaivable law.

18. Limitation of Liability

To the fullest extent permitted by law, Encore and its owners, personnel, and authorized service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the Site.

To the fullest extent permitted by law, Encore’s aggregate liability for a claim arising solely from use of the Site will not exceed the greater of $100 or the amount, if any, paid specifically for access to the Site during the 12 months before the event giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited and do not limit rights or obligations under an issued insurance contract or nonwaivable insurance, privacy, consumer-protection, communications, licensing, suitability, best-interest, or other legal duties.

19. Indemnification

To the extent permitted by law, you agree to indemnify Encore and its owners, personnel, and authorized service providers from third-party claims arising from your unlawful misuse of the Site, material violation of these Terms, or content you submit in violation of another person’s rights. This obligation does not apply to the extent a claim results from Encore’s negligence, willful misconduct, violation of law, or other conduct for which liability may not lawfully be shifted.

20. Regulatory and Consumer Rights

Nothing in these Terms prevents you from contacting or filing a complaint with an insurance department, attorney general, court, law-enforcement agency, the Federal Communications Commission, the Federal Trade Commission, or another government authority.

California consumers may obtain insurance assistance and verify licensing information through the California Department of Insurance at insurance.ca.gov or (800) 927-4357.

21. Governing Law and Disputes

Except where another jurisdiction’s law must apply, these Terms and Site-related disputes are governed by California law, without regard to conflict-of-law rules. Before filing a private Site-related claim, the parties are encouraged, but not required where prohibited or impracticable, to provide a written description of the issue and allow a reasonable opportunity for good-faith resolution.

Nothing in these Terms requires arbitration or waives a jury right. Any later arbitration agreement or waiver must be separately and expressly agreed in a legally enforceable form.

22. Changes to These Terms

Encore may update these Terms to reflect changes in law, technology, Site features, vendors, or business practices. Changes apply prospectively when posted or on a later stated date. Material changes will receive additional notice or affirmative consent when required by law.

23. General Provisions

If a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These Terms and the notices expressly incorporated for their stated subjects constitute the agreement governing general Site use but do not replace transaction-specific insurance or business documents.
